1. Purpose
These Terms of Sale govern the sales made on the website https://lheritieredesbellesombres.com/ by the L’Héritière des Belles Ombres atelier.
Any order placed on the website implies full and complete acceptance of these terms.

3. Products
The products offered for sale are handcrafted pieces, including in particular:
• restored antique lighting fixtures
• handcrafted lampshades
• unique lighting creations
• bespoke pieces.
As each piece is handcrafted or derived from antique objects, slight variations, irregularities, or marks of time may exist.
These characteristics contribute to the unique character and authenticity of the creations and cannot be considered defects.
Each product is presented with the greatest care through its descriptions and photographs.
However, due to screen settings, lighting conditions, or the nature of the materials used (textiles, metals, antique elements), slight variations in color or appearance may exist between the visuals presented and the final product.
The customer is invited to review this information before placing an order.
Validation of the order and payment constitutes acceptance of the product’s condition and characteristics.
3.1 — Antique Objects
Restored antique lighting pieces offered for sale may show signs of age related to their history and antiquity.
These characteristics, such as slight irregularities, patina, or signs of use, are an integral part of the character and authenticity of the pieces.
They cannot be considered defects.
Each piece is carefully restored to preserve its original structure and character.
4. Price
Prices are indicated in euros (€).
The atelier reserves the right to modify its prices at any time.
The price applicable is the one displayed at the time the order is placed.
Shipping costs are indicated before the order is confirmed.
5. Order
The order is validated once the payment has been confirmed.
For bespoke projects, a quotation is provided.
Production begins after the quotation has been approved and a 30% deposit has been paid.
5.1 Bespoke Orders
Restoration, reinvention, or bespoke creation projects are subject to a prior quotation.
Approval of the quotation and payment of a 30% deposit allows the project to begin.
Once the piece is completed, photographs may be sent to the customer to allow them to review the final result before shipment.
The remaining balance of the order is due before shipment or collection of the piece.
The deposit paid at the time of the order constitutes a firm commitment and is non-refundable, except in exceptional cases considered by the atelier.
In the event of project cancellation by the customer after approval of the quotation, the deposit remains the property of the atelier.
If specific materials have been ordered or work has already begun, the atelier reserves the right to charge for costs already incurred.
6. Use and Installation of Lighting Fixtures
The lighting fixtures offered for sale are designed and restored with the utmost care.
Installation of the lighting fixtures (including pendants, chandeliers, or wall sconces) must be carried out in accordance with applicable electrical safety standards.
It is the customer’s responsibility to ensure that their home’s electrical installation is compliant and suitable for the product.
In case of doubt, it is recommended to hire a qualified professional for installation.
The atelier cannot be held responsible for any damage resulting from improper installation, inappropriate use of the product, or any modification made to the lighting fixture after delivery.
Lighting fixtures must be used with bulbs appropriate for their recommended maximum power.
7. Payment
Payment for orders may be made using the methods offered on the website (credit card, secure payment platform).
All transactions are secure.
8. Retention of Title
Products remain the property of the L’Héritière des Belles Ombres atelier until full payment of the price by the customer.
Full payment includes the product price as well as any applicable shipping costs.
In the event of non-payment, the atelier reserves the right to reclaim ownership of products that have not been fully paid for.
9. Shipping
Products are shipped to the address provided at the time of order.
Delivery times may vary depending on:
• the availability of the pieces
• the complexity of production
• the destination of the shipment.
The atelier cannot be held responsible for delays attributable to the carrier.
10. Right of Withdrawal
In accordance with applicable legislation, the customer has a period of 14 days from the receipt of the product to exercise their right of withdrawal.
The customer must return the product within 14 days following the communication of their decision to withdraw.
The product must be returned in its original condition and packaging, or in packaging that ensures equivalent protection to guarantee safe transport.
Return costs are the responsibility of the customer.
The customer is responsible for any depreciation of the product resulting from handling other than what is necessary to establish the nature, characteristics, and proper functioning of the product.
In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for products made to measure or clearly personalized at the customer’s request.
Therefore, restoration, reinvention, or bespoke creation projects carried out by L’Héritière des Belles Ombres are not eligible for the right of withdrawal.
The request for withdrawal must be made through a clear statement expressing the intention to withdraw.

11. Exceptions to the Right of Withdrawal
In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to bespoke or personalized creations.
12. Liability
The atelier cannot be held responsible for any damage resulting from improper use of the products.
Lighting fixtures must be installed and used in accordance with applicable electrical standards.
13. Intellectual Property
The creations, photographs, and website content are protected by intellectual property law.
Any reproduction or use without authorization is prohibited.
14. Disputes
These Terms of Sale are governed by French law.
In the event of a dispute, an amicable solution will be sought first.
If this fails, the competent courts will be those of Pau, France.
